At JEMEC Automotive Limited (JEMEC) your privacy is important to us and the security of your data is taken seriously. This privacy policy explains what personal data we collect from you, how and why we use it, and how you can correct any inaccuracies.

We collect and use personal data in line with the Channel Islands Data Protection (Jersey) Law 2018 and the UK GDPR.

  • The details of vehicles you have purchased from us, sold to us, part-exchanged for another vehicle, driven in a test-drive or as a courtesy loan vehicle, for example registration number, VIN, mileage, and service/repair history.
  • CCTV footage from visits to our dealership.

We also collect information you choose to provide and the content of communications you send us online, by post or by phone. We may monitor and record phone calls.

3. How we collect your data

We use your data to provide you with products, such as vehicles, providing finance quotes on behalf of a finance provider, providing a warranty, and arranging servicing and repairs to your vehicle. We require this data to meet the legal requirements for providing you with these products and services. We also use your data to offer you high levels of customer service and support. We use data to develop aggregated analysis and intelligence that enable us to operate, protect, make informed decisions and report on the performance of our business.

Communications

We use data we collect from you to communicate with you and personalise these communications to make them relevant to you. We may contact you by phone, email, letter or SMS to inform you of any safety or maintenance work which is due or overdue on your vehicle, to provide you with information relevant to you and your current vehicle, to update you regarding your vehicle status, to give you information which you have requested, to request feedback about a service you have received from us or to let you know when a contract for a product or service you have purchased from us is ending. You can also consent to receive relevant promotional communications from us by email, SMS, post or phone.

In addition, where you have consented to marketing communications, or where, after an appropriate balancing assessment, it is in our legitimate interests to do so, we will process data to send you those communications, in line with prevailing data protection legislation and the channels used, for example email, SMS, phone or post.

Advertising

We may use data which we collect in your interactions with us, and some third party services to show advertising.

When you visit our website, your browser stores a unique identifier in a cookie, which is then used by third parties such as Google or Bing to show you adverts relevant to the products or services you have viewed on our site. We may also share this data with third parties, such as Facebook so that they can deliver our advertisements to you within their platform.

The ads that you see may also be based on data we process about you, such as your previous transactions with us, search queries or the content you view. We will hold indirectly obtained data for advertising purposes. 7. How we share your data

We share your personal data when it is necessary for us to provide you with a product you have requested or purchased. We may also share data with companies working on our behalf or when it is required by law. We never sell or rent your data to third parties.

If you ask us to provide you with a finance quotation, we will share the information you provide us with local financial institutions.

If you have a warranty included with your vehicle purchase, we will share your information with the warranty provider.

We may also share your data with companies we use as agents, for example to provide customer service support or to assist us with protecting, cleansing, managing and securing our systems and databases.

In all cases, third parties must abide by this data privacy notice and are not allowed to use the personal data they receive from us for any other purposes.

We may transfer or disclose your personal data in the following circumstances:

  • If we sell any of our business, we may disclose your personal information to the prospective buyer of the relevant business.
  • In the event of a duty of disclosure due to compliance with legal obligations.
  • To enforce or to comply with our terms and conditions of use for non-compliance.
  • For the purposes of fraud protection and credit risk reduction.

10. Making a Data Subject Access Request (DSAR)

You may request access to the data we hold about you by making a Data Subject Access Request (DSAR):

  1. Tell us you are making a Data Subject Access Request (DSAR) and provide your full name and preferred contact details.
  2. Provide enough information for us to verify your identity. We may ask for a copy of ID and/or proof of address.
  3. Send your request to datacontroller@jemec.je or by post to: Data Controller, JEMEC Automotive Limited, Norman House, La Grande Route de St Martin, St Saviour, Jersey, JE2 7GR.

We will respond as early as possible and normally within one month of receiving your request and any information needed to verify your identity.

You may also ask us to correct inaccurate data or raise concerns about potential misuse by contacting our Data Controller.

If you have consented to receive marketing communications but later change your mind, you can update your preferences by calling 01534 281281 or emailing datacontroller@jemec.je. Please note that if you request no further marketing communications, we will still send any contractual, statutory or safety recall notices where applicable.

Restriction of processing: you can ask us to restrict the processing we carry out with your personal data. Where we do not have a legal obligation to continue processing, we will implement your request. If we are legally obliged to continue, for example, to honour warranties or enable product recalls, we will explain why we are unable to restrict processing.

Profiling: we may use profiling within marketing communications to help ensure any offers or information we send are relevant to you.

Erasure, “right to be forgotten”: you can ask us to remove your data from our systems. If you still own a JEMEC vehicle we may need to retain certain information to meet legal obligations and to contact you if necessary, for example, in the event of a safety recall. Where we have no valid reason to keep your data, we will delete it within one month of receiving your request.
